Legal Action from the USA  - The Hawk didn't Duck!

Angela Anderson never saw what hit her.  It was, in fact, a large plastic banana, and it ended up costing Ohio State University $25,000 plus court costs. 

Anderson, then of Council Bluffs, Iowa, was dressed as the University of Iowa mascot, Herky the Hawk, for a 1999 football game held at Columbus, Ohio.  Anderson was struck from behind by the banana, which was swung by an Ohio State band member sitting on the shoulders of another band member.  X-rays later revealed that Anderson had suffered a hairline fracture of the spinous process, one of the little bumps on the vertebra just below the neck.  Anderson filed a lawsuit against Ohio State in November 2001, and a settlement was reached in late December of last year.

As a report on the case in the Omaha World-Herald notes, Herky the Hawk was at the centre of a 1997 incident in which members of the University of Minnesota marching band attempted to pick up the mascot and ram its head into a goal post.  In an ensuing melee, Herky was tackled from behind, splitting its head open.  However, none of the students who wore the costume during that game were injured.
